The answer is yes, in Pennsylvania if you’re not wearing a helmet you can recover damages from the other driver. It does not bar you from seeking compensation. Of course, we encourage you to wear a helmet when you’re driving, for safety reasons. Of course, if you are hit by a vehicle, the chances of you sustaining a head injury are reduced when you are wearing a helmet.
