Every auto accident case is different. Some require that you go to court. Some don’t. The factors which determine whether you go to court or not are whether there is a liability dispute or whether they are not offering fair value for your claim. If they’re not offering fair value for your claim, then, yes, you would be filing a lawsuit and potentially go into court.
