Understanding the Laws Pertaining to Trips and Falls and Slip and Falls
Trip and fall or slip and fall accidents are frequently referred to by lawyers and insurance company adjusters as slip and fall cases, but the legal implications are the same no matter what you call it. The negligent conduct for which a property may be held liable is allowing an unsafe or dangerous condition to be created or allowed to continue to exist that causes you to fall and be injured.
Your reason for being on property owned by a person, business or government entity can be a factor in your ability to sue for damages caused by a fall accident. Generally, there are three classifications used to designate your status in relation to the property owner:
- Business Invitee: This is when you enter a property at the express or implied invitation of the owner or person in control of the property. A shopper in a retail store is an example of an invitee. Property owners owe a duty to take steps to warn and protect business invitees from hazards and conditions on the property that could cause them injury.
- Licensee: A licensee is similar to an invitee in entering onto another person’s property with the permission of the owner, but property owners do not owe as high a degree of care to licensees as is owed to invitees. For example, a property owner is not responsible for inspecting the property to discover hidden hazards that could harm a licensee as must be done in cases involving an invitee.
- Trespasser: Entering onto someone’s property without their permission or consent limits the property owner’s duty to you. A property owner only owes a trespasser the duty of not engaging in conduct that would intentionally harm the person.
The duty owed to you by the property owner will be a factor in determining if you receive compensation. Our attorneys are skilled at reviewing the facts of a fall to identify the duty owed to you and the evidence needed to prove it in court.

Frequently Asked Questions About Trip and Fall and Slip and Fall Claims in Philadelphia, PA
Have questions? We are here to help. Still have questions or can't find the answer you need? Give us a call at 215-610-3440 today!
-
Your first priority is your health, so seek medical attention as soon as possible, even if you think your injuries are minor. Report the incident to the property owner or manager and ask that an incident report be created. If you are able, take photos of the hazard that caused you to fall, such as a wet floor, broken sidewalk, pothole, or poor lighting, and get the names and contact information of any witnesses. Keep copies of all medical records, bills, and receipts. Finally, speak with a Philadelphia trip and fall attorney before dealing with insurance companies so your rights are protected from the start.
-
Property owners and those in control of property have a legal duty to keep their premises reasonably safe. Whether they are responsible for your fall depends on your status on the property and the nature of the hazard. For example, business invitees, such as shoppers, are owed a high duty of care that includes inspecting for and fixing dangerous conditions or warning about them. Licensees are owed a lesser duty, and trespassers are owed only a minimal duty. An attorney will look at how the fall occurred, how long the hazard existed, whether the owner knew or should have known about it, and what steps were taken to fix or warn about the danger.
-
Trip and fall and slip and fall accidents can occur in many different ways. Common causes include uneven stairs or walkways, broken sidewalks or pavement, potholes in parking lots, broken tiles or torn carpeting, and loose or missing handrails. Slip and fall hazards often involve icy or snow covered sidewalks, wet or debris covered floors in stores or buildings, and poor lighting in stairwells or parking lots. When property owners allow these conditions to exist without timely repair or adequate warning, they can be held liable for resulting injuries.
-
If your fall was caused by a property owner’s negligence, you may be entitled to compensation for medical expenses, lost wages, reduced earning capacity, pain and suffering, and other accident related losses. In more serious cases, this can include long term rehabilitation, assistive devices, or home modifications. Because insurance companies often argue that “accidents just happen” and try to shift blame onto the victim, having an experienced trip and fall attorney on your side is important to document your injuries, prove the property owner’s duty and negligence, and pursue the full amount you deserve.
