What is a hazardous condition and who is responsible for it?
In the context of a slip and fall claim, a hazardous condition is a condition that a reasonable person wouldn’t have left there and that’s dangerous, that can cause a fall and an injury. A hazardous condition can be anything from, again, a hole, a crack, a substance on the floor, something that you couldn’t see. A defect that’s covered. Landowners are responsible for it, or occupiers of the land. Somebody who’s renting the land. And of course the person who created the hazardous condition is also responsible.
