Can a person be guilty of drunk driving in Pennsylvania if they only had one drink?

Return to Video FAQs

Transcript:

Probably not. I guess it depends upon how big the drink was, but if you have one beer or you have one mixed drink, or you have a glass of wine, you’re likely, very likely not to be over the legal limit. In Pennsylvania, the legal limit for a blood alcohol content is .08.

.08 is usually two or more drinks within a one hour period. It does depend upon your weight and size and whatnot, but one drink you’re probably safe. Be careful though, because if you have anything else in there, in your system aside from that one drink, that could give you a problem, such as illegal drugs.
